Terms and Conditions (T&C)

1. Scope of Application

These General Terms and Conditions (T&C) apply to all contracts concluded between Clube Boss and consumers or businesses through the online shop at clubeboss.eu. Deviating terms of the customer are not accepted unless Clube Boss expressly agrees to their validity in writing.

2. Contract Partner and Contact

3. Offer, Product Presentation, and Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By completing the ordering process, you submit a binding offer. The contract is concluded when we accept your order by sending an order confirmation email or by dispatching the goods. Automated order receipt confirmations do not constitute acceptance.

Technical and design deviations (e.g., slight color differences due to screen settings) remain reserved within reasonable limits.

4. Prices, VAT, and Shipping Costs

All prices are in Euros and include statutory VAT. Any shipping costs are clearly displayed at checkout before completing the order. Promotional prices and discounts are time-limited and non-combinable unless otherwise stated.

5. Payment Terms

Available payment methods (e.g., Shopify Payments, credit card, PayPal) are shown at checkout. Payment is due upon conclusion of the contract. In case of chargebacks or failed payments, we reserve the right to claim incurred costs.

6. Delivery, Delivery Times, and Availability

Deliveries are made within Germany. Standard delivery time is 5–12 business days from shipment confirmation. Allow 1–2 business days for processing before shipping. Partial deliveries are permitted if reasonable for you and do not incur additional shipping costs.

If a product is permanently unavailable, we will refrain from accepting the order; no contract is concluded in this case. We will inform you by email of any temporary delivery delays.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal of 14 days from receipt of the goods. Details, deadlines, exceptions, and the sample withdrawal form are provided in our Right of Withdrawal. Additional provisions are described in the Returns and Refunds Policy.

9. Returns

Please notify us of returns in advance via customer service and follow the return instructions sent by email. Unless otherwise required by law, customers bear the direct costs of returning the goods. Further details can be found in the Returns and Refunds Policy.

10. Statutory Warranty

Statutory warranty rights apply. For obvious transport damage, please report it to the carrier if possible and notify us immediately to facilitate any claims against the carrier. Failure to report does not affect your statutory rights.

11. Liability

We are liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, body, or health. In cases of slight negligence in breaching essential contractual obligations, our liability is limited to the typical, foreseeable damage. Otherwise, liability is excluded. Mandatory statutory liability provisions remain unaffected.

12. Vouchers, Discount Promotions, and Gift Cards

Vouchers and discount codes are single-use and redeemable only within the specified period unless otherwise stated. Cash redemption is excluded. Gift cards can be used for goods offered in the shop; any remaining balance stays on the card.

13. Customer Account

Creating a customer account is optional. Account credentials must be kept confidential. Clube Boss reserves the right to suspend accounts in case of abusive use.

Information on the processing of personal data, cookies, analytics tools, and marketing services can be found in our Privacy Policy.

15. Alternative Dispute Resolution, EU Platform

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board. Statutory rights remain unaffected.

16. Force Majeure

Events beyond our control (e.g., natural disasters, strikes, official measures, telecommunications network failures, pandemics) may delay performance of the contract. In such cases, deadlines are extended accordingly; further statutory rights remain unaffected.

17. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection provisions of the country where they have their habitual residence apply. If the customer is a merchant, the exclusive place of jurisdiction is the registered office of Clube Boss; however, we are entitled to sue at the customer’s general place of jurisdiction.

18. Changes to the T&C

We reserve the right to amend these T&C if necessary to remedy subsequent imbalances or to adapt to changed legal frameworks. We will notify you of significant changes in due time. For contracts already concluded, the T&C in effect at the time of contract conclusion apply.
